What we see the patent utilization trends of Universities in Taiwan

University campus has unique free research atmosphere, with abundant research manpower and improved research and development facilities, creating a lot of human knowledge and good growth environment, naturally become the origin of intangible assets. However, in the early years, the academic research and development results show that, in general, for most of the papers or writings, to be published are preferable. The mainly promotion ways for the Professors of Universities are publishing research papers. The willing for patent application or technical transfer is not high. In practice, the professors mostly prefer to write academic papers in pursuit of academic status rather than apply for patents.

In the medium term, the idea is more spread to academia, based on world trends and the foundry of Taiwan, which is the main industry type and the impact of intellectual property, making the industry aware of the importance of protecting intellectual property. The government then developed various laws and regulations and with the reward system, the campus research results gradually presented in two ways, one for the academic papers published, and the other for the protection of intellectual property system.

As for the recent year, the amount of patent protection through the intellectual property system became outbreak. These patents are divided into two kinds, that is, the theoretical patents output from the academic universities, and practical patent applications output from technical-oriented universities.

By the experience of PIIP (Portal International Intellectual Property) Group operating patent projects for many years, we found a problem in the process of assisting the University to practice patents. That is, an application-based patent is actually associated with the manufacturing field. The original purpose can match the need of industry technology. However, the industry can not actually use the technology of the patents. The statute provides that the technology is not as patent-like design. We can see that the law does not match the practical world. This may be just the tip of the iceberg. But, for the practicality of the technology derived from the campus, it is necessary to improve from the direction of ideas and policies, then, the real implementation can show the real meaning of the patent.

In recent years, Taiwan enterprises falls into “foundry difficulties” and the gross margin is poor, while facing the threatening of “China supply chain”. It reduced the bargaining power of Taiwan’s manufacturing industry. Taiwan enterprises how to rely on the power of research and development, innovation, transformation and upgrading, is absolutely imminent thing. Over the past 10 years, Taiwan’s US patent application “booming” has leapt to 5th place in the world, has gradually from the United States advanced patent law to learn to grow, and gradually with the patent pioneer countries closer. In view of the transformation of university research results, the invisible patented technology can be used for enterprises not only to create real income value, but also for the University of accumulating future research fund.

Patents can be not only the protection of the enterprise R & D products, but also the weapons to attack the opponents. In recent years, the international patent war has played fiercely, the lack of patent weapons in the hands of Taiwan enterprises often become the subject of the litigation. How to combine the patented technology developed by the University, the proper use of patents to protect their rights, and from which to obtain more and greater benefits, has become an important issue of cooperation between industry and academia.
