News Letter : Good News！！！TIPO speeds up the procedure of AEP、PPH and TW-SUPA !
According to the prior regulations of Examination Acceleration in Taiwan, such as AEP(Accelerated Examination Program)、PPH(Patent Prosecution Highway) and TW-SUPA(Taiwan-Support Using the PPH Agreement)：”Any patent application request for accelerating examination while not been published yet, the applicant should file the request for early publication while filing the request for AEP, PPH and TW-SUPA, and should pay the official fee NTD 1,000.
However, since Taiwan Intellectual Property Office (TIPO) speeds up the examination procedure recently to clean up the patent application backlog efficiently in these years, the patent application almost can start up the examination procedure before publication (18 months from filing date/ priority date). Therefore, if TIPO still maintain the condition of” early publication” as the requirement for proceed the examination of PPH, it would cause the inconvenience and affect the international cooperation on PPH. Meanwhile, comparing to the procedure of the other countries, such as JPO(Japan Patent Office)、KIPO(Korean Intellectual Property Office)、USPTO(United States Patent and Trademark Office), etc, there is no such regulation on early publication requirement.
In view of the above consideration, from April 1, 2016, the invention application which request for AEP、PPH and TW-SUPA yet not been published, no need to request for ”early publication” any more. Not only reduce the payment of official fee, but also promote the utilization of various procedures of Examination Acceleration.
